Zomato faces legal trouble for delivering kebabs from Lucknow in less than 30 minutes | Delhi News – Times of India

NEW DELHI: Zomato, the application based food delivery service, is in the hot seat for delivering food too quickly. One of your users in Gurgaon wanted galauti kebab from a shop in Lucknow, 500 km away. Zomato He delivered it in less than 30 minutes.
The user, Sourav Mall, 24, filed a complaint in Delhi’s Saket court, claiming that this feat of fast delivery by Zomato was inexplicable and that instead of the spicy aromas of the kebab, he had smelled “a fraudulent practice and unfair.” , intended to misrepresent and mislead the class of consumers who purchase food products from Zomato.”
“Issue suit summons and notice of application u/O 1 Rule 8 CPC to the accused through all permissible modes, upon submission of PF within 7 days from today. Filed on 20.03.2024” , the bench of civil judge Umesh Kumar said in the recent order.
Zomato did not react when approached by TOI.
Sourav questioned the app’s promise of quick service under the Zomato Legends sub-service, which allows foodies to order dishes from cities outside their city of residence. Select famous stores and their legendary dishes are available for ordering through this subservice.
Using the Legends service on October 14, 2023, Sourav ordered four dishes. Three dishes were from shops in Delhi and one from Lucknow. The dishes were chicken kabab roll from Jama Masjid, triple chocolate cheesecake from Kailash Colony, a vegetarian sandwich from Jangpura and galauti kebab from Lucknow.
The petition said the restaurants were all over Delhi and at a considerable distance from their location at that time. Zomato, however, promised to deliver the food hot and the estimated time of arrival (ETA) displayed ranged from 20 to 45 minutes. “It is, therefore, inexplicable how Zomato is able to manage delivery from iconic restaurants in Delhi to delivery locations in Gurgaon/Noida within 30 minutes, that supposedly too hot food. Such representation to users, customers and/or clients of Zomato, they are actually trying to mislead the public,” he said.
The food was delivered to Sourav within 15 minutes in Zomato packaging, not the partner’s packaging, according to the petition. The outer paper bag featured Zomato’s Intercity Legends subservice.
“This conduct is fraudulent and violates Zomato’s service standards and manner of propagation as shown to the plaintiff and the class represented through this lawsuit. Therefore, this opaque and false business modus operandi provides the plaintiff and the represented class a proper reason to approach the honorable court.Further, Zomato, though consciously providing such poor quality and service to the plaintiff and the consumers of the represented class, continues to advertise and suggest that it is getting fresh and hot food from these legendary restaurants around the corner,” the petition said.
The plea was filed in the form of a representative complaint under Order 1, Rule 8 of the Code of Civil Procedure, 1908, stating that as there are numerous affected individuals, it would not be possible for each of them to approach the court. Therefore, the plaintiff represents Zomato customers placing orders in Delhi-NCR through a class action lawsuit in a representative suit.
